1. Acceptance of Terms

By accessing and using the Unblank Service ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. Your use of the Service indicates acceptance of these Terms.

2. Description of Service

Unblank is a real-time call assistant service that uses artificial intelligence to process live call context and provide real-time suggestions or assistance during calls. Unblank does NOT record, store, or retain call audio or transcripts. The Service is provided "as is" and is subject to these Terms and our Privacy Policy.

3. User Eligibility

• You must be at least 18 years of age to use the Service
• You must have the legal capacity to enter into binding contracts
• You must comply with all applicable laws and regulations in your jurisdiction

4. Permitted Use

You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of others. Prohibited conduct includes:

• Harassment, threats, or abuse of any kind
• Illegal activity or fraud
• Impersonation or misrepresentation
• Using the Service to train competing AI systems
• Reverse engineering, hacking, or attempting to access Service infrastructure
• Automated scraping, crawling, or bulk downloading of content

4.1 Call Consent and Legal Compliance

You are solely responsible for complying with all applicable laws relating to communications, privacy, monitoring, recording, consent, and data protection in the jurisdictions where you use the Service.

If applicable law requires notice, disclosure, or consent from call participants before using software that processes live audio or provides real-time assistance, you are solely responsible for obtaining such notice, disclosure, or consent.

Unblank does not determine whether consent is legally required in any jurisdiction and assumes no responsibility for your compliance with applicable laws.

4.2 No Control Over Call Outcomes

Unblank provides real-time suggestions, guidance, and information to assist you during calls. You are solely responsible for all decisions, statements, and actions you make during calls. Unblank does not control call outcomes, does not determine what you say or do, and bears no responsibility for the consequences of your conduct or decisions during or after any call. Your use of suggestions provided by Unblank is entirely at your discretion.

4.3 No Professional Advice

Unblank provides suggestions, guidance, and real-time assistance for conversations. Unblank does not provide legal, medical, financial, tax, employment, investment, or other professional advice. You should not rely on Unblank's suggestions as a substitute for professional advice from qualified attorneys, physicians, financial advisors, accountants, or other licensed professionals. If you require professional advice, consult with a qualified professional in the relevant field.

5. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify us of any unauthorized use of your account. We are not liable for unauthorized access resulting from your failure to protect your credentials.

6. Intellectual Property Rights

6.1 Unblank Content

• All content, features, and functionality of the Service are owned by Unblank or our licensors and are protected by copyright, trademark, and other intellectual property laws
• You may not copy, modify, distribute, or transmit Unblank's content without explicit written permission

6.2 Your Content

• Call Profile and account data you provide is used solely to deliver the Service during active sessions
• We do not retain call recordings or transcripts
• You are responsible for ensuring that you have rights to share any information through the Service

6.3 Call Data and Summaries

• Unblank does NOT record, store, or retain call audio or transcripts. During a live call, audio is processed in memory only to generate on-screen suggestions and is discarded when the session ends.
• Call summaries and notes are generated on-request only and are controlled by you. You choose whether to save them locally to your own device or discard them.
• Unblank does not store call summaries or notes on its servers. Anything you choose to keep is written only to the location you select on your own device.
• Practice Mode is the sole exception: when you explicitly choose to save a practice session, its transcript and coaching scores are stored in your account so you can review them, and you may delete them at any time.

7. Service Availability

• We strive to maintain continuous Service availability but do not guarantee uninterrupted service
• The Service may experience downtime for maintenance, updates, or unforeseen technical issues
• We are not liable for losses resulting from Service interruptions

8. Limitation of Liability

To the fullest extent permitted by law:

• Unblank is provided "as is" without warranties of any kind
• We disclaim all warranties, including fitness for a particular purpose and non-infringement
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability is limited to amounts paid by you in the 12 months preceding the claim

9. Indemnification

You agree to indemnify, defend, and hold harmless Unblank and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

10. Billing and Payment

• Subscription fees are displayed before purchase
• Payment is required to access paid tiers of the Service
• Billing cycles and renewal terms are specified at time of purchase
• You may cancel your subscription at any time through your account settings
• NO REFUNDS will be issued, including for partial subscription periods. All sales are final. See our Refund Policy
• For custom pricing, volumes, or team deployments, contact Sales@GetUnblank.com. Custom terms will be documented in a separate written agreement.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time. We are not liable for any modification, suspension, or discontinuation of the Service.

12. Termination

• You may terminate your account at any time by contacting Support@GetUnblank.com
• We may terminate your account immediately if you violate these Terms or engage in illegal activity
• Upon termination, your data will be retained as specified in our Privacy Policy

13. Dispute Resolution

Before initiating formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. These Terms are governed by the laws of the United States, and you agree to submit to the exclusive jurisdiction of the courts located in the United States.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties regarding: (A) the accuracy of Service suggestions, (B) uninterrupted access, or (C) fitness for a particular purpose. You use the Service at your own risk.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, such provision will be severed, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Unblank regarding the Service.

17. Changes to Terms

We may update these Terms at any time. Changes become effective upon posting to GetUnblank.com. Your continued use of the Service constitutes acceptance of updated Terms.
